SW Backyard Buildings ("we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect through swbackyard.ca (the "Site"), how we use it, who we share it with, and the choices available to you.

3. Information We Collect

3.1 Information You Provide Directly

We collect personal information that you voluntarily provide, including:

  • Project details — information about the building, shed, or service you're inquiring about (dimensions, location, timeline, site conditions, budget, preferred options).

  • Transaction information — order details, deposits, quotes, invoices, and related correspondence. (Payment card details are processed directly by our payment processor — see Section 6.)

  • Communications — the content of emails, texts, web form submissions, chat messages, and phone calls.

  • Marketing preferences — whether you've opted in to email or SMS marketing, and your communication preferences.

3.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect:

  • Device and browser data — IP address, browser type and version, operating system, device type, screen size, referring URL.

  • Usage data — pages viewed, time on page, clicks, scroll behaviour, search terms, date and time of visit.

  • Cookies, pixels, and similar technologies — including first-party and third-party cookies from analytics and advertising platforms (see Section 7).

  • Location data — approximate location derived from IP address, and, if you grant permission, more precise location data.

3.3 Information from Third Parties

  • Advertising platforms (e.g., Google Ads, Meta / Facebook Ads) — information about ad engagement, conversions, and audience signals.

  • Analytics providers (e.g., Google Analytics) — aggregated and individual interaction data.

  • Referrals and partners — if another business or individual refers you to us.

  • Publicly available sources — such as public business directories.

4. Why We Collect Personal Information (Purposes)

We collect, use, and disclose personal information for the following purposes:

  • To respond to inquiries and provide quotes.

  • To fulfill orders, schedule installations, and deliver services.

  • To process payments and issue invoices or receipts.

  • To communicate with you about your project, account, or transactions (transactional messages).

  • To send marketing emails and SMS messages — only where you have given consent (see Section 5).

  • To operate, maintain, and improve the Site and our services.

  • To build custom and lookalike audiences to reach prospective customers (only using information permitted under applicable platform terms and privacy law).

5. Consent for Email and SMS Marketing (CASL)

5.1 Express Consent

We send commercial email and SMS messages only to individuals who have given us express consent (for example, by checking an opt-in box on our website, subscription form, or checkout page) or where we have implied consent under CASL (for example, within 24 months of a purchase or 6 months of an inquiry).

5.2 What You're Agreeing To

When you provide express consent to receive marketing communications from SW Backyard Buildings, you agree that we may send you:

  • Promotional emails and newsletters with information about products, seasonal offers, new models, promotions, tips, and events.

  • SMS text messages relating to promotions, product availability, order updates, appointment reminders, and other service-related messages.

Message frequency varies. Standard message and data rates from your mobile carrier may apply to SMS messages. Consent to receive SMS messages is not a condition of purchase.

5.3 How to Withdraw Consent (Unsubscribe)

You may withdraw your consent and unsubscribe from marketing communications at any time, at no cost:

  • Email: Click the "unsubscribe" link at the bottom of any marketing email, or email us at [privacy@swbackyard.ca].

  • SMS: Reply STOP to any marketing SMS message to opt out, or HELP for assistance. You may also contact us directly.

We will process unsubscribe requests within 10 business days, as required by CASL. Withdrawing consent for marketing messages does not affect transactional messages (for example, order confirmations or service updates) that we need to send to complete your purchase or service.

5.4 Identification in Every Message

Every commercial email and SMS message we send will identify SW Backyard Buildings as the sender, include our contact information, and provide a functioning unsubscribe mechanism.

6. How We Share Your Information (Third Parties)

We do not sell your personal information. We share personal information only with trusted service providers and partners who help us operate our business, and only to the extent necessary for the purposes described in this policy.

6.1 Web Conductors Inc. — Our Digital Operations Partner

We have engaged Web Conductors Inc. ("Web Conductors"), a digital marketing and operations agency based in Barrie, Ontario, to manage our website, marketing automation, CRM, advertising campaigns, and customer communications.

Web Conductors processes personal information on our behalf through its proprietary client platform ("Web Conductors Command Centre," or "WC3"), which operates on a licensed third-party CRM infrastructure. Specifically, Web Conductors may:

  • Manage our customer and lead database.

  • Send marketing emails and SMS messages on our behalf (only to individuals who have consented).

  • Create and manage Google Ads and Meta Ads campaigns, including custom audiences.

  • Track website activity, form submissions, and conversions.

  • Provide reporting, analytics, and customer support tooling.

Web Conductors acts as our service provider and is bound by contractual obligations to protect your personal information and use it only for the purposes we authorize. The WC3 platform and its underlying infrastructure may store and process data on servers located in Canada and the United States.

6.2 Advertising and Analytics Platforms

We share limited personal information with the following advertising and analytics platforms to deliver, measure, and optimize our marketing:

6.3 Other Service Providers

We may also share personal information with:

  • Payment processors — to process deposits, payments, and refunds (we do not store full payment card numbers on our systems).

  • Email and SMS delivery providers — to send transactional and marketing messages on our behalf.

  • Hosting and infrastructure providers — to host the Site and our business systems.

  • Shipping, logistics, and installation partners — to deliver and install your order.

  • Professional advisors — accountants, lawyers, and insurers, where reasonably necessary.

6.4 Legal and Safety Disclosures

We may disclose personal information without your consent if required or permitted by law — for example, in response to a court order, subpoena, regulatory request, or to protect our rights, property, or the safety of others.

6.5 Business Transactions

7. Cookies and Tracking Technologies

The Site uses cookies, pixels, tags, and similar technologies to:

  • Deliver and measure advertising across Google, Meta, and other ad networks (e.g., Google Ads conversion tag, Meta Pixel).

You can control cookies through your browser settings and, where available, through the cookie preferences banner on the Site. Disabling cookies may affect how certain features of the Site work.

8. Cross-Border Data Transfers

Some of our service providers (including Google, Meta, and certain components of the WC3 platform) are located in or process data in the United States and other countries. When your personal information is transferred outside of Canada, it may be subject to the laws of those jurisdictions, including lawful access by foreign courts, law enforcement, and national security authorities.

We take reasonable contractual and organizational measures to ensure that any personal information transferred outside of Canada receives a comparable level of protection to what it would receive in Canada.

9. How We Protect Your Information

We use physical, technical, and administrative safeguards to protect personal information against loss, theft, and unauthorized access, disclosure, copying, use, or modification. These include:

  • Encryption in transit (HTTPS/TLS) for data submitted through the Site.

  • Access controls limiting personal information to staff and service providers who need it.

  • Contractual protections with service providers, including Web Conductors.

  • Regular review of our security practices.

No method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security, but we take our obligations seriously and will notify you and the Office of the Privacy Commissioner of Canada of any breach of security safeguards involving your personal information that poses a real risk of significant harm, as required by PIPEDA.

10. How Long We Keep Your Information

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by law, contract, or legitimate business need (e.g., tax, warranty, accounting, and dispute resolution purposes). When personal information is no longer required, we securely destroy, erase, or anonymize it.

11. Your Rights

Under PIPEDA and applicable Canadian privacy law, you have the right to:

  • Access the personal information we hold about you.

  • Correct inaccuracies in your personal information.

  • Withdraw consent to our collection, use, or disclosure of your personal information, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may affect our ability to provide certain services.

  • Unsubscribe from marketing emails and SMS messages at any time (see Section 5.3).

  • Challenge our compliance with this Privacy Policy or with PIPEDA.

To exercise any of these rights, contact our Privacy Officer using the details in Section 2. We may need to verify your identity before acting on your request. We will respond within 30 days, as required by PIPEDA.

If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada: priv.gc.ca.

12. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have collected information from a child, please contact us and we will delete it.

13. Links to Other Websites

The Site may contain links to third-party websites. We are not responsible for the privacy practices of those websites. We encourage you to review the privacy policies of any third-party sites you visit.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. When we make material changes, we will update the "Last updated" date at the top of this policy and, where appropriate, notify you by email or through a notice on the Site. Your continued use of the Site after such changes constitutes acceptance of the updated policy.
